Terms of Use
Effective date: March 14, 2025. These Terms of Use govern access to maxiaapp.com and the Maxia mobile application.
1. Acceptance of Terms
By accessing or using Maxia, you agree to these Terms of Use. If you do not agree, do not use the service.
2. Use of the Service
Maxia is intended for personal fitness and wellness use. You agree to use the service in compliance with applicable laws and not to misuse, interfere with, or attempt unauthorized access to the app, website, or related systems.
3. Accounts
You may need to create an account to access some features. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account.
4. Subscriptions
Maxia may offer free and paid subscription tiers, including Pro and Coach plans. Paid features may be billed on a recurring basis as described at the time of purchase.
Unless otherwise stated, subscriptions renew automatically at the end of each billing period until canceled. You authorize the applicable app store or billing provider to charge the recurring subscription fee, along with any applicable taxes or fees.
5. Billing, Renewal, and Cancellation
If you subscribe through Apple, billing is handled through the Apple App Store. If you subscribe through another platform, billing is handled by that platform. Subscription pricing, renewal timing, and related terms are presented during checkout.
To avoid renewal, cancel your subscription through your Apple ID settings, Google Play account, or other purchase platform before the next renewal date. Except where required by law or platform policy, fees already paid are non-refundable.
6. Health and Medical Disclaimer
Maxia provides fitness, wellness, and performance-related information only. It is not a medical service and does not provide medical advice, diagnosis, or treatment. Always use your own judgment and consult a qualified professional for medical concerns.
7. Intellectual Property
Maxia, maxiaapp.com, and related content, designs, branding, and software are owned by or licensed to Maxia and are protected by applicable intellectual property laws. These Terms do not grant you ownership of the service or its content.
8. Prohibited Conduct
You agree not to:
- Use the service for unlawful or harmful purposes
- Attempt to reverse engineer or disrupt the service
- Access another user’s account without authorization
- Upload malicious code or interfere with app security
9. Service Changes and Availability
We may modify, suspend, or discontinue any part of Maxia at any time, including features, content, or subscription offerings. We do not guarantee uninterrupted or error-free availability.
10. Termination or Suspension
We may suspend or terminate access to Maxia if we reasonably believe you violated these Terms, created risk for the service or other users, or where required for legal or security reasons.
11. Limitation of Liability
To the fullest extent permitted by law, Maxia and its affiliates, licensors, and service providers are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, profits, or business opportunities arising from your use of the service.
To the fullest extent permitted by law, the total liability of Maxia for any claim relating to the service will not exceed the amount you paid for Maxia in the 12 months before the claim arose, or fifty U.S. dollars if you have not made any payments.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of Maxia after updated Terms take effect means you accept the revised Terms.
